Terms of Service
These terms govern use of the Import & Pricing application (the “Service”), operated by [LEGAL ENTITY NAME]. By using the Service you agree to them. If you are using it on behalf of an organisation, you confirm you are authorised to accept these terms for that organisation.
What the Service is
An operations tool for computing an independent estimate of landed cost on Barbados imports, and for comparing that estimate against customs assessments you record. It is not a customs broker, not a filing system, and not a source of professional advice. Its output is informational — see the Disclaimer, which forms part of these terms.
Accounts and organisations
Access is by account, and every account belongs to an organisation. Administrators of an organisation may invite further users and set their roles, and can see the data of that organisation. You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you believe an account has been compromised.
Your data and your content
You keep ownership of the documents and figures you put into the Service. You grant us only the permission needed to operate it for you — to store your content, process it (including automated reading of uploaded documents), display it back to you, and back it up. Handling is described in the Privacy Policy.
You confirm you have the right to upload what you upload, and that doing so does not breach an obligation of confidence you owe to someone else.
Acceptable use
- Do not use the Service to break the law, including customs, sanctions and tax law.
- Do not present its output as an official assessment, a customs ruling, or professional advice.
- Do not attempt to access another organisation's data, probe or disrupt the Service, or circumvent its limits.
- Do not resell or redistribute access without our written agreement.
Availability
The Service is provided without any uptime commitment. We may change, suspend or discontinue it, and we may impose or adjust usage limits — including limits on automated document processing, which carries a real per-use cost.
No warranty
The Service is provided “as is” and “as available”, without warranty of any kind, express or implied. We do not warrant that computed figures are accurate, complete, or current, or that the Service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, [LEGAL ENTITY NAME] is not liable for indirect, incidental, special or consequential loss, or for lost profits, lost business, or duties, taxes, penalties or interest assessed against you. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us for it in the twelve months before the claim, or one hundred Barbados dollars.
Nothing in these terms excludes liability that cannot lawfully be excluded.
Termination
You may stop using the Service at any time and ask us to delete your organisation's data. We may suspend or terminate access if these terms are breached, or if continuing to provide the Service becomes impractical. On termination you may request an export of your data within thirty days.
Changes to these terms
We may update these terms. Material changes will be signalled in the application; continuing to use the Service after that means you accept the updated terms.
Governing law
These terms are governed by the laws of Barbados, and the courts of Barbados have exclusive jurisdiction over any dispute arising from them.
